Only one smoker and one business have been taken to court for flouting Scotland's strict anti-smoking laws in the year since they were introduced, it emerged yesterday.
Critics of the ban predicted open disobedience by smokers, but Scottish ministers claimed yesterday it had been a "tremendous" success after learning that only 175 people were fined for breaching the law.
The first smoker to be prosecuted for refusing to stop smoking in an enclosed public place is due in court in Aberdeenshire next month.
Official statistics confirmed yesterday a very high rate of compliance by businesses with the regulations, which require all covered public places, including shops, cafes, taxis and factories, to display no-smoking signs. More than 55,000 workplaces had been visited but only one had been prosecuted. Another 14 had been given on-the-spot fines.
Andy Kerr, the Scottish health minister, said the public had embraced the legislation far more than expected. "I think we're further ahead than we ever thought we would be. Just weeks after the ban had been in place people had taken to it, understood it, and understood the good reasons for it.
"None of the doom and gloom occurred. None of the mass civil disobedience that was projected by some people actually happened."
Although the Scottish Licensed Trade Association said a third of bars had laid off staff after the ban and that drink takings were down 11%, opinion surveys suggest 80% of Scots believed the ban had been a success.

South Somerset District Council has contacted restaurants in Scotland to find out what impact the new laws have had on trade. The responses have been promising with the reactions showing that the laws are workable, as long as you make plans for them.

Restaurant manager at the Stage Door Restaurant in Aberbeen, Andrew Graham, said: "You have to be prepared. We were lucky in Scotland as there was a big media campaign before the legislation came into force so everyone was aware of the impending change.

"Our sales have not been affected by the ban. We were prepared and had ashtrays on tables outside the restaurant, and our sister pubs and restaurants bought heaters and shelters.

"We were a little worried during the night before the smokefree legislation came into effect, as it was a step into the unknown, but those worries have since been proved unfounded.

"The bottom line is, as long as you're prepared for the legislation, then the change should pass very smoothly. People in Aberdeen very quickly adjusted to the new laws."

SCOTLAND'S licensed trade is marking the first anniversary of the ban on smoking in public places with a warning that the law is denting business and costing jobs. It claims that a third of pubs have had to lay off staff and that drink sales are 11 per cent down on the days before the ban.

But a year on, the remarkable thing about the smoking ban is what a success it has been. Only eight fines have been handed out in Edinburgh to companies or individuals for flouting the ban, indicating a very high rate of compliance with the law.

Council leaders say they are delighted with the way the ban has been accepted in the Capital - and if it is resulting in better health and more people giving up smoking, it has to be a good thing.

Of course, there have always been opponents of the ban, and publicans have naturally been concerned about the impact on their trade. Bingo halls, too, have complained of a dramatic fall in attendances and profits.

But despite the claims of the Scottish Licensed Trade Association, there is no proof that any drop in sales is down to the smoking ban rather than any other factor. And while some pubs report a fall in takings, others say that business is booming - not least from an increase in people having meals.

Pubs are now more attractive places for people to spend an evening, because it no longer means breathing in other people's smoke, risking your health and going home with your clothes stinking of smoke.

Health Minister Andy Kerr has reasonably observed that he has not met anyone who wants to turn the clock back and reintroduce smoking in pubs and restaurants.

There were successful instances of a smoking ban elsewhere - notably New York and Ireland - but Scotland led the way in the UK on this health-promoting initiative. The Westminster Government originally proposed a much less comprehensive ban south of the Border, but was eventually forced to toughen up its plans and is now following Scotland's example.

South Somerset District Council (SSDC) has urged licensees to get their applications in no later than May 11.

Jean Marshall, SSDC’s development control team leader, said: “Businesses will need to get their applications to us as soon as possible. The May 11 deadline would only guarantee a decision – this would not allow time for the shelter to be built.

“We are governed by an eight-week turnaround period for all minor applications, smoking shelters fall into this group.

“The eight-week turnaround is also governed by the quality of information the applicant provides with the application. If there are pieces of information missing, then it is likely that the decision will be delayed, or refused.”

Cllr John Farley, SSDC portfolio holder for economic development, planning and transport, said: “We have been given a very tight deadline by the government to get the district ready for smoke-free legislation, and this is shown with the urgency in getting planning applications to the council.

“The initial contact must be to determine if your application needs planning permission. Businesses should contact the duty planner so they can receive advice.”

Smoking ban will not cost a packet

Lighting up will not be allowed in public places from July 1
FROM July 1 it will be illegal to smoke in a public place such as a pub, restaurant or place of work.

Deemed a success in Scotland and the Republic of Ireland, it is hoped the ban will work just as well here.

It will still be legal to smoke in a location considered a place of residence such as homes, residential and care homes, prisons and hotels.

With this in mind, the Herald spoke to some of the pubs, bars and clubs in and around Harlow to see how they are preparing for the upcoming ban...

William Aylmer (Wetherspoon's) Kitson Way

Gemma Madden, deputy manager: "The area outside will be for smokers, and we are going to put heaters and seating out there. Our smoking customers aren't happy, but I can't see us losing a lot of trade. It will boost the food trade a lot."

Chequers, Commonside Road

Leanne Russell, general manager: "We are having the outside area done. We are going to have nice furniture and heated lamps fitted in May or June.

"We've had a mixed reaction from the customers. A lot don't agree with it, but they are still going to come into the pub so it shouldn't be too bad.

Fat Sam's, Terminus Street

TONY Greener, senior duty manager: "We are looking to purchase some space outside the club from the council to put outdoor smoking facilities for smokers; these will include seating and outdoor heaters.

"We've not had many comments from customers because it still seems very up in the air and even we don't know the exact ins and outs of what will happen.

"I think the ban will have a short-term effect, but in the long term the belief is that it will increase business.

"Pubs that do food will benefit the most from the ban, but nightclubs may struggle a bit.

- Policing the ban will be the responsibility of council workers, rather than local police.

Harlow Council has received £36,000 to recruit staff who will raise awareness of the new law and the implications if it is broken among landlords and managers.

A council spokesman said: "We are expecting that formal enforcement will only be required in a very small number of cases.

"The staff will work with businesses to ensure that they know how to police the legislation themselves without heavy intervention from us.

"We are confident that this will be all that's required for most businesses. In the small number of cases where this is not enough we will take enforcement action and we will act on complaints.

"We already work closely with most licensees through schemes such as Pub Watch."

The council officers that currently work with businesses ensuring food safety, health and safety at work as well as licensing will continue to work with venues in the town.

Thousands to police smoking ban

Thousands of council staff are being trained to police the smoking ban in bars, restaurants and shops in England.
Ministers have given councils £29.5m to pay for staff, who will be able to give on-the-spot £50 fines to individuals and take court action against premises.

They will have the power to enter premises undercover, allowing them to sit among drinkers, and will even be able to photograph and film people.

The smoking ban is due to come into force on 1 July. It covers virtually all enclosed public places including offices, factories, pubs and bars. But neither outdoor space nor private homes will be affected.

Business owners also have a duty to ensure their customers comply - they are liable for £200 fines if proper signs are not displayed and, potentially, fines of £2,500 if they refuse to enforce the ban.

Local authorities have been given the power to enforce the ban so it does not consume police time.

A government-funded course is expected to train 1,200 council officers in the next few months with more expected to follow later.

Councils will use these fully-trained officers to brief other staff on how to enforce the law as many towns and cities will have scores of officers patrolling public places.

The teams will be made up of new staff and existing officers who will be freed up to carry out inspections and offer advice.

In London, there will be several hundred of the so-called anti-smoking police.

In Westminster, scores of council officers will able to issue fines, but the authority points out that the time taken up policing the ban will be equivalent to only two full-time posts.

Ian Gray, policy officer for the Chartered Institute of Environmental Health and chief trainer for the government course, said he expected most councils would take a "softly, softly approach" at first.

"But there will be some occasions where action has to be taken and I am sure the compliance officers will not shy away from that," he added.

"These officers do not have to identify themselves when they go into premises and they can even film and photograph people to gather evidence although this may not be appropriate in many cases.

"There will be two ways of doing this, either staff can go in and identify themselves to the landlord, but they don't have to."

In Nottingham, there will be about 30 officers patrolling the city, composed of new staff and existing environmental health officers.

But the council is also exploring the possibility of getting street wardens, who currently aid the local police force, to help ensure the ban is effectively enforced.

Steve Dowling, director of environment and public protection at Nottingham City Council, said: "We have about 100 wardens and they could keep an eye on whether people are smoking in pubs as they go about their other duties.

"But it is not just about pubs and restaurants. We will also be looking at the likes of car garages and shops are complying as well."

In Liverpool, there will be a core team of about 20 to 25 staff keeping an eye on public places, although in the first few days after the start of the ban the council is planning to do a mass patrol of the city with 200 staff.

Unexpected benefit of Scotland's smoking ban as hotel industry saves tens of thousands of pounds a year on sheets.

Two of Scotland’s leading independent budget hotels are reporting a surprise benefit to the country’s smoking ban – a huge saving on sheets, duvets and pillow cases.

Every year careless smokers were responsible for destroying a large amount of linen as even the slightest burn mark forced hoteliers to throw away stained or damaged bedding.

However, since the smoking ban came into force in March 2006 The Osbourne Hotel In Edinburgh and McLays Guest House in Glasgow have reported a significant financial saving on the amount of bedding lost to accidental damage.

”It has saved us a fortune in linen,” said Shahid Chaudhry, director of The Osbourne Hotel situated in the middle of Edinburgh and McLays Guest House in central Glasgow.

”In the past all it took was one careless guest to leave a burn make in a sheet or duvet and it had to be thrown out. We got through a lot of stuff that way – but no more.

”We’ve saved several thousand pounds a year. When you multiply that across all the hotels I would estimate the smoking ban has saved the industry tens of thousands of pounds already.

”The ban has been good for the hotel industry in Scotland. If the ban hadn’t been introduced when it was we would probably have imposed our own no-smoking policy.
“Increasing numbers of guests were specifically requesting non-smoking rooms before the new rules came into force and because we allowed smoking in the hotel it put some people off. Now everybody is happy.”

Since the smoking ban was introduced just under a year ago it has been hailed as one of the most successful pieces of legislation introduced by the Scottish Parliament.

Fears that it would damage the hospitality industry, lead to civil disobedience as smokers refused to comply and do little to improve the health of the nation appear to have been largely unfounded.

Almost from the start of the ban the compliance rate among smokers and the managers of public venues was close to 100 per cent.

In addition the monitoring of staff traditionally required to work in smoke filled rooms has shown a clear improvement in health and the majority of smokers have accepted the ban cheerfully, with a third of them claiming it has helped them cut down.

In a country where 19 per cent of 15-year-olds smoke and an average of 13,000 Scots die every year from tobacco related illnesses the ban is regarded as having brought the biggest change to everyday life in Scotland for decades.

THE anti-smoking legislation being introduced from the beginning of April will carry a lot more clout than the normal Government health warning.

Flout the Smoke Free Premises (Wales) Regulations 2007 and it could cost business dear, with hefty fines awaiting employers turning a blind eye to staff lighting up in and around the workplace.

The legislation, which comes into force in Wales on April 2 as part of the Health Act 2006, affects every business of every size and basically bans all smoking in enclosed work premises and public places.

Exactly what makes an enclosed workplace is laid out in the legislation and you've basically got to be working in the middle of a field not to be affected.

Many employers are waking up to the fact that this legislation will actually mean a lot more than not allowing staff to smoke at work - and they need to get their act together now.

Employers should draft a no-smoking policy and inform all staff of what the new legislation will mean. They are also required by law to erect no-smoking signs in the workplace at or near each entrance which have to be a specific size, shape and design, and the wording has to be bilingual.

Company vehicles that either carry members of the public or are used for work by more than one person - even at different times - must also be smoke free zones and carry no-smoking signs, and it will be an offence under the legislation not to do so.

As a law firm we are receiving an increasing number of calls for advice from businesses across South Wales, asking questions like whether they can erect a portable cabin in the office car park for staff to smoke in.

The simple answer is there is no way around this legislation and the only thing companies can do is to provide an outdoor smoking shelter, something that looks a bit like a bus shelter with no sides, front or back to it, and well away from other staff. But if you have an anti-smoking employer then the only option for smokers will be to stand in the wind and rain or huddle in doorways outside.

There are some occupations where smokers will be able to carry on lighting up on the job. Those who work in the open air - farm labourers, council parks staff, postmen and window cleaners should be able to smoke, providing it's when they're outside.

There are official exemptions to the Act, too. Patients receiving palliative care in adult hospices - like T Hafan in Sully - will be allowed to smoke within designated rooms, as will patients in mental health units and the residents of care homes for the elderly.

Hotels will also be allowed to designate some bedrooms as 'smokers' and self-contained residential holiday accommodation will also be exempt.

Private houses will also not be affected by the legislation - unless you're running a business from the house and other people apart from the person living there are working there, in which case that part of the house must be smoke free. The same is true if you employ someone like a housekeeper to work full-time in your house.

However, it appears those hired to work occasionally or on a periodic basis in private houses - a domestic help, plumbers, painters and decorators or builders carrying out maintenance work or someone providing personal health care - can carry on smoking in the homes of their clients.

It will be up to the local councils in Wales to enforce the legislation and the Wales Assembly Government has agreed to make additional resources available to local authorities to fund the recruitment and training of enforcement officers.

Penalties will range from up to £200 for smoking illegally at work or in an enclosed public place like a pub or restaurant, to up to £2,500 for an employer who allows staff to smoke illegally at work.

Until the Act comes into force we won't be sure just how vigorously it will be enforced, but from the noises being made already it seems fairly certain the Assembly means business with this piece of legislation.

Try smoking ban, businesses urged

Firms in Wales are being asked to try out a smoking ban to get ready for the arrival of the official ban in April.
"Try It" urges firms to bring in a ban on smoking in public places for an hour, a day, or even permanently.
